Hi,
We have raised $ 8,300 as of last night(Jan 8th) and we need much more than that. You can check status of funds raised at "Why Contribute" link on www.immigrationvoice.org
Here is the thing: You can contribute now if you have not and stop waiting until "others take care of the problem". That "others" is made up of people like you. If you cannot contribute a few dollars to help eliminate retrogression by funding a non-profit org that is going to lobbying in the next few weeks, then probably you are not bothered enough and retrogression is fine by you. If that is the case, then maybe I am talking to the wrong audience. If you are prepared to wait for 6-7 years for your green-card and keep extending your H1 until then and waiting for 6-7 years is fine by you, then good for you. You dont have to worry about anything and I can understand if you wish not to do anything about it.
But if you care, then volunteer or atleast contribute money towards efforts to eliminate retrogression and eliminate backlogs. What is the worst that could happen? Think about it. What if everyone thinks that "there are other people who are working on this and they will take care of the problem so I will just wait and watch, maybe contribute later on when they actually start doing something. Even if I dont contribute, they will take care of the problem and the changes in laws will benefit everyone anyways whether I participate or not". Well, that is the kind of thinking that leads to catastrophes. Do not rely on "Others". Because "others" might think that you are doing it and you might think others are doing it. That never ends and once we cross into second half of 2006, you can forget about congress acting on immigration just before elections in 2006. YOU have to do something about this. If you dont stand up for what you believe in, then you dont believe strongly enough. There is justice in the world, but its not automatic.
If you have doubts and would like to talk to one of the volunteers then please call us at 281-576-7185.
Talk to one of the volunteers. See if you can relate to the efforts of Immigration voice. A phone call and a few minutes of time is the least that you can do to act on a problem that can be a constant nightmare for the next 6-7 years if you want your GC within a more reasonable timeframe.
You can also check out www.immigrationvoice.org before you call so that you can find out more about us and ask us all the questions that you might have.
Thanks,
Logiclife.

Little_Willy,
Yes, it is that simple. If you just walk away from your home, bank can only touch your home and credit history. They can not go after your automobile\gold\savings\other property....anything. You are not missing anything. That is why we are seeing so many people around us just walking away from their homes. Thank God I rent but if my property's value go down 200 k in 2 years, heck I would walk away with a smile on my face. No strings attached.
Walking away would have been difficuly had you put 20% down, i.e. involving your hard earned money in the deal. In that case you would have waited to see the market and hoped that it would revive. If put 0% down and bank has given you 100% loan, then it is the bank who has taken all the risk. You have practially no risk in that deal. Just like cloth....return it to the bank. Hey....you don't have to even clean it up...like you do in the case of apartment move. ;-)
0% down, ARM, interest only.....when all these goodies were floating around, it was hard to resist.
I was absolutely pissed off with the "local" ppl that got greedy and dragged the whole economy with them. Seeing that there are ppl like you (one of us) who are pretty much the same, i am seething with rage. Because of idiots like you, people with a pristine credit history of more than ten years and some saved money cant buy a decent house in the bay area (and elsewhere) and have to see their hard-earned money go down the drain in 401k and stocks.....I wish ppl like you rot in foreclosure hell and no one ever lends credit you, ever again!!!

NEED HELP!!! what are my options?
I485 denied on Oct 24th 2008. I did not get the letter and realized only when I checked on the USCIS website. My attorney also did not get the letter of denial or even the NOID.
I changed jobs in June 2006 by invoking AC21 (Priority Date - Oct 2002, I140 and I485 filed concurrently, I140 approved in Feb 2005).
The fact is that on all forums there is talk about revocation by previous employer. However please note that approved I140 could either be revoked or substituted. While those AC21 memos talk about revoked I140, the law is not clear when previous employer substitutes the approved I140. I know the substitution process is no longer legal since June 2007, however, it has been abused in the past. My questions to forum members:
1. Is any one in similar situation?
2. I have H1B only until June 2009, Can I work until then assuming MTR is resolved in 2 months (per some optimistic posts on IV)
3. if my employer were to file a PERM labor application--can I port my previous priority date?
Mohican
As per some opinions, H1 also gets invalidated when 485 is revoked past 6 years limit of H1B. Did you also get your EAD revoked?
To answer your question#3, my lawyer said I should be able to retain PD from earlier approved 140 in such scenario. Check with yours.

I already took Vonage world phone. I am happy with it. However, I happened to see somewhere in the thread about Lingo offering india calling even through the mobile. That had me give a second thought on switching over to Lingo.
However, when I read the fine print on the lingo site, it mentions you cannot call Mobile phones in India. This catch makes me go crazy. Can some one confirm how are they handling with this constraint. Is that still a good option to switch over vonage to lingo based on this single feature?
Thoughts are welcome...

The percentage of people here are a very small percentage of that 25%.
H1/L1 restrictions are not going to encourage american kids. It does not impact their thinking. Maths, science are tougher subjects for kids. Kids in India were pushed by their parents to study science in search for a good career. Kids here have a lot other avenues which are more attractive to a kid. Kids do not understand L1/H1. 90% of adult population here does not understand H1/L1. REstricting H1/L1 will not influence a kid to take up science and engineering.
I have news for you (and the certitude with which you make your claims here are laughable). Computer science graduation rates in US went up this year by 6-8%, because the visa caps since 2003 remained at 65000 instead of 195000 creating some demand here. I personally know kids who wanted to go to Computer science, but went for other areas like health care because of the lack of offshoring/H1 etc. If the crooked Indian offshorers and fly-by-night operators are not driving down the wages, more americans will go to computer science, as they would go for a career as MD or Pharmacist or lawyer (almost all those careers need at least 6-8 years of college). They also know that professional associations like AMA or APhA wouldn't allow importing foreign workers by corporations/hospitals on a scale that H1-bs are imported in IT area
Based on my experience, I wouldn't say that Indian kids have any special skills in maths or science compared to americans. Contrary to what you claim, people are aware of H1s and offshoring(may be so much on the exploitation of L1) as they talk to friends and family and guidance counselors at school. Most of the IT jobs were Indian H1-bs are employed doesn't even need computer science or engineering degree. Some of the best architects I have seen in IT didn't have a computer science major. A green-horn from TCS/INFY with a computer science degree and pretending to be an architect doesn't mean he is the best IT professional available in the market.

What is the correct adress to send the I485 at nebraka center via fedex
and how to assemble the i 485 and 765 packet
Sorry, I did not see the Fedex part of your question, but here is what I have found from experience:
I had to send some tax related documents to the IRS earlier this year. And I went to UPS. They said that they themselves do not deliver to P.O. Boxes, but take the help of the USPS to get the job done.
So, I went to the post office, sent it via the one where they give you a tracking number, and it worked out fine, and cheaper. I intend to do the same this time.
Regarding the arrangement of documents in the packet, I would refer you to:

Here is the email response which I have received from Mumbai N IV.
=====================
Dear Sir:
Thank you for your correspondence, regarding electronic verification of H, L, O, P and Q petitions through the Petition Information Management Service (PIMS).
PIMS is now the sole source for confirmation that a NIV petition has been approved.
All questions regarding this new service should be directed to the Bureau of Consular Affairs Public Inquiries Division of the State Department. You may contact them at the following numbers and e-mail addresses:
Fax Number: 202-663-3899
Public Inquiries: 202-663-1225
Public e-mails (automated replies only): usvisa@state.gov
In case we do receive the electronic verification an email will be sent to you regarding the same. Once you receive the mail you will need to submit your documents to the VFS. We regret we cannot give any timeframe regarding the completion of this process. I hope this information has been helpful to you.
Regards,
Mumbainiv/cg
=====================
Sorry to say, this new system has been designed and implemented not taking into consideration,how it is impacting all the applicants. There is no timelines which are published for cases like ours. In short the new system will delay things.
:confused::mad:
I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.
For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Much easier to try and do it from there rather than from here.
There is no number to call here to check on status - I have been sending emails to mumbaiNIV@state.gov but have not received any response from them yet. Not really a surprise. If anyone tries the number above and gets some response please let the rest of us know.

In case we do receive the electronic verification an email will be sent to you regarding the same. Once you receive the mail you will need to submit your documents to the VFS. We regret we cannot give any timeframe regarding the completion of this process. I hope this information has been helpful to you.

=====================
Sorry to say, this new system has been designed and implemented not taking into consideration,how it is impacting all the applicants. There is no timelines which are published for cases like ours. In short the new system will delay things.
:confused::mad:

After some days I don't see any discussion on this. Guys, take this seriously and come with a concrete idea of how to proceed with this idea...

Whats also surprising is that number of pending EB1(India) applications is far less than expected. That would definately help EB2(India) in the spill-over (quarterly or yearly)
