    A: If you don't use the EAD to work, you might be able to keep your F-1 status. If you use the EAD, you are no longer in F status. Rather, you would be in I-485 pending status, which means if your I-485 application is denied before the completion of your study, you can no longer stay in the U.S. to finish the program.

    So, there's chance that my resubmission will be rejected because my PD is not current. wow that's heavy for me. all i can do is hope that this won't happen to me. they didn't say though that i can only resubmit only if PD is current.

    I had a missing check issue for my son and USCIS returned his application (which was filed on the last day before retrogression in September 2005). But I re-submitted saying that it was not my mistake. The mail section returned the re-submitted application saying that the date was not current. Then I remembered an excellent news entry in the immigration website www.immigration-law.com about bypassing the mail section so as to directly reach the officer's table of the service center by writing some magic words on the envelope cover. (You need to search his archives around sep/Oct 2005 - hopefully it is still there I have forgotten those words). I did exactly that with a strong covering letter. USCIS accepted the application and issued a receipt notice. I think your case is not as bad as it appears and you should be able to make it get accepted.

    I dont understand one thing, In 2008 the number of labor approvals was less too compared to 2007 or 2006, Then why didnt PD move significantly in 2009 ? and why will it now ?

    Can we have a comparision between spill over numbers of 2009 compared to 2010 and its still better if 2008 is compared to these two year's. from the same DOL website


    I think this kind of comparision will give a good picture if the dates will move or not

    Even though there was spillovers, dates did not move significantly due to heavy backlogs. Perm was introduced in March 2005. Labor apps were sent to backlog centers. Processing was significantly slow in 2006, 2007. Dates were current for EB2 even during mid 2005. This was due to slow processing and not because there were not many applicants.

    USCIS claimed to have caught up on processing in 2009, therefore cleaned up a lot of old cases and began pre-adjudications. This is helping them issue visas based on priority date. So dates may have not moved much but they did clean up the backlogs.

    Now the hope is that dates will move a little faster and more orderly for Eb2-I in 2010.

    Hello everyone,

    I got my TB skin test solution in my forearm on Friday evening. I have to visit the Doctor again on Monday to show them my forearm for the result. There is a mild swell on my arm today (30 hours) and I am thinking the skin test is going to be positive. My Doctor warned me before we started all this. He told me people from India sometimes show positive on Mantoux test and they usually get an X-Ray and then TB is declared negative after that. He told me it takes a week to finish the X-Ray process.

    I am wondering if they are any members who had a positive TB Skin test and had to get their X-Ray done. Why does this procedure take 1 full week? How long did it take for you? Any more inputs on what to do? is this a big deal?

    Note: I was not sure if a thread existed for such questions. Hence, I started a new one. Moderators, feel free to move my question to the relevant thread if it exists.

    I went through this process.No need to worry even if it is possitive.Doctor asks us go for X-ray and It'll come out normal , then he'll give us the sealed envolope.x-results comes to doctor in 2 days.Many of my friend's got + ve for skin test and and their x-rays are normal.

    On the other hand, even if you have GC or citizenship, you will still face lay-off, relocation, etc. The probabily of losing the job is always there, and there is no way to escape it. Therefore, owning a house with H1 is not much different from with GC/citizenship, riskwise. There is always a possibility that you might be forced to sell the house, so you need to take that into account whenever you are making a house-purchasing decision, no matter what your status is.
    Risk-wise, if you are H1 and kicked back home with 1M debt, you might be able to simply forget about it. if you are GC/citizenship, will you be willing to forfeit that for 1M debt? So, if you are making risky RE investments, H1 is actually better...
    The basic tenet of buying a house (to live in; not for investing purpose only) is that you should own it for at least three-four years so that you do not have to sell it for a loss. Like any financial cycle, RE also moves in a sine curve, so you should be able to ride the wave. The average appreciation has been just about 3% over the last many many years...the recent housing boom being a rare occurence.

    If you are on a H-1B, then buying a house depends on your risk-taking capacity. What if you were to lose your job? What if you have to move within the US to find a job? What if you have to return to India? Because owning a house is not a one-time expense...there is the monthly mortgage, monthly dues, RE taxes, insurance, HOA fees (for some), maintenance, etc. So you should know what you are getting into when you buy a house on a H-1B because you don't want to sell it for a loss only because you lose your job and have to go back. Like any financial cycle, RE also moves in a sine curve, so you should be able to ride the wave. Of course, you can keep the house even if you go back, but I doubt RE would be a financially savvy investment given its historic rate of return.

    However, my wife and I (even though we were both working on H-1Bs and had not even applied for our LCs), we decided to take this risk and bought a house in 2001. We made sure that even if one person was to lose his/her job, we should still be afford to that house. The house has appreciated significantly only to stabilize in the last year or so, but we are now perfectly happy with the decision we made. Of course, hind sight is always 20/20!

    We are now looking to move into a bigger house, and I can tell you that being in AOS (finally) gives a totally different feeling of comfort and financial security. We now know that even if we were to lose our jobs, we wouldn't have to sell the house for a loss since we would be able to ride the wave. Most importantly, your physical presence in the US gives you a lot of options to get a job and the lack of visa sponsorship opens several doors that were once closed.

    So the bottom line is that you don't need to have a GC (or be in AOS) to buy a house; but it certainly makes the decsion process a lot easier.

    hello,

    me/spouse filed 485 in june 2007. eb3 - PD 2003 april.

    today i received a RFE notice in email for both the applications.

    did anyone see similar activity on their application?

    im wondering if this is request asking for re-medical exam or re-fingerprint as almost 21 months have passed since then.

    ne ideas?

    Do not panic, wait for the RFE hard copy and work with the attorney/company to respond. It is most likely a common RFE like birth certificate, W2, recent pay stubs, medical and etc.

    Way to Go!!

    Someone else posted on this board that they needed to first see how IV team spent the money, and only then that person would contribute.

    To the sceptics among Readers out there ---- please note that this is the first time that we have successfully come together and achieved something. I have full faith in the IV team. Talking about doing something is different from doing it. It takes real grit to
    a) Spend your personal time and money.
    b) Talking to public, bureaucrats, press, etc., at the risk of not getting encouraging responses.
    c) Coming together as one team despite disparate goals and objectives
    d) Talking to, or getting their employers involved (this is not an easy task).

    Members, please take a moment to reflect upon yourselves, and see how many of the above (all of a, b, c, d, may be?) you would be able to pull off on your own with no effort from a forum such as IV.

    I am glad to be associated with such a perseverent group, and I would want the core team to guide subsequent efforts to bring about reform in the immigration system that affects hundreds of thousands of "huddled masses".

    I totally agree with idea of sending flowers to white house. I meeting couple of florists in this area to know if they can send us flowers for a cheaper rate. If immigrationvoice gives me permission I can coordinate sending flowers from local store in DC
    If team leaders agree I can order all the flowers and will fax the bill and later they can reimburse me. If the quantities are large then we can get the discount from local merchants

    How large was your wife's mark was? I know a friend who started medication ( PPD mark was 15 mm and x-ray negative and doctor signed the papers) after consulting with a specialist and another person who got RFE in similar case.

    My wife's mark was 20mm and x-ray -ve. What kind of problem will it generate? What was the case of your another friend who got RFE? So, even if x-ray is -ve, she has to take medicines?

    Yeah, Lets have "Cry Parties", like the "Tea Parties", where EB sufferers get together to cry, and fill up a bucket of tears.
    Let us then package these tears in clear plastic bottles, and show them on TV....may be send those to lawmakers...so that they get an idea of our pain.....

    I am working for a small company based out in MSP and the lawfirm with which we work is very good. The staff of this lawfirm are very knowledgeable and helpful.

    Most of my queries are answered in time and i havent had any issues. More importantly their office is right opposite to USCIS and i have seen folks from USCIS at my lawfirm for expert opinions.

    If you are from Minnesota, and looking for a good lawyer i can sure refer them.
