Why is an amendment required if you are using portability? And if an amendment is required anyway, what is the advantage of using portability - cant I just amend my H1 and be done?

If you plan to stay on H1 with your employer and you move to a different location , then new LCA & amendment is needed. Amendment has nothing to do with AC21 or EAD or 485.

Hi All
I would appreciate if gurus can pitch in their suggestions regarding EAD Expring and how to handle AC21 Situation.
My EAD is going to expire in Sept and have applied for EAD renewal in June( Efiled) had completed FP on July 2 and still no update regarding the EAD approval.
1) As I am on AC21 what will happen come september and My EAD is expired and new EAD has not arrived
2) Can I continue job as I have receipt for EAD renewal or have to quit the job and wait till EAD renewal CARD comes in mail.
I am EB3 India with PD of December 2004 .

30/08: Got Soft LUD on old EAD/AP and on I 485( both me and my Wife)
29/08: Got a Hard LUD on AP ( Both me and my wife)
So are these indicating that my file has been touched and they are ready to work on my EAD?

I sincerely hope the folks buck up and send back the passports with stamping. I sincerely also hope that when stamping comes, it comes 100% correct.

If you send your 485 receipt copy and Marriage Certificate you should be fine. Since she was applied as your dependant, you have to submit your 485 as well and marriage certificate to prove your relationship.

Get the appointment ASAP. if you case gets RFE, you can postpone your appointment anyways. To get an appointment in Toronto is the Hurculean task.

1) If we loose job while on EAD, do we go out of status like on H1
2) Is EAD renewal totally EMployee responsibility - even in Big companies with Immi Department (i.e. Employee pays for renewal fees yearly and has to hire attorney or do it himself with the USCIS)

2) Companies pay for all costs, but this differs from company to company and your understanding with HR when they started the GC for you

December VB is an eye opener. Doesn't matter EB3 or EB2, unless WE get together to work for change, it will be a very long wait to complete the GC process for many of us.

They want the commison to decide the number of EB GCs and this is backed by the unions. Generally unions do not like competation and want to restrict immigrants. The commison will say the 10 million americans are unemployed, so there is no need for EB immigrants. Because of outsourcing there will not be any shortage for any IT related job. So the demand will never be there. So its easy for the union and their commison to stop EB immigrants. We need to fully oppose this move. Its very cunning and calculative move by the antis....

1. If union and commission considering to improve immigration system for 12 million illegal people and why not to improve immigration for legal workers.
2. Out sourcing may be an answer for IT jobs, but still demand for on site worker is there & will improve once economy comes back on track. I think, out-souring is answer to big projects but not for small or mid-level projects.

Hi Guys,
My friend just called. He got a call from USCIS officer yesterday to confirm his and spouse's information. After the call, he told, congratulations, your application for AOS is approved!! He also said that case status will be updated online in 24-48 hours.
My friend couldn't believe it:D so he called his lawyer and the lawyer is baffled :confused: as well because their PD was Jun 2005. They concurrently filed under class A (labor exempt).
How can that be possible, visa bulletin never showed PD for June 2005 to be current?
Well, I am happy for my friend and his family:p but now I am speculating, that they must have requested visa numbers for all approvable cases in the system regardless of priority date!! What a mess!:(

based on a lot of experience in talking to a lot of people and personally going through and also a lot of research and tyalking to people, Attorneys, infopass officers, congressional liasons, customer service, ombudsman etc.....
Here is what this whole thing looks like.
Different service centers operate differently ie TSC is different in procedures from NSC. In TSC the process of handling any kind of letters, requests etc... is kinda big secret and we never know how they handle stuff.
When you send communication with a covering letter explaining your reason, we usually do not get any acknowledgement.
If you call cusotmer service - there is no way they can look into the system and tell you what is happening if at all someone opened your physical file and added your communication.
People at infopass have also tried their best to know about their cases in detail but not able to get any help.
Now, we do not know if it is an issue with lack of proper process in place or if staff do not have much authority to deal with things through independent decision making or whatever, we have no idea how all this works.
If you want to let USCIS know that you changed job, there is no harm in doing it. Do not expect that they will send a letter back acknowledging it.
But if you send a letter to USCISt hat you are withdrawing your GC for some reason .... then yes - you will get a prompt response back that your request has been processed.
I think you all understand the difference.
When one changes jobs under AC21 - be ready for an RFE or a NOID or a denial if 140 gets revoked. If your 485 gets denied, you can resolve it through a MTR.

We filed our I-485 on July 6th at NSC & planning to file EAD/AP on our own using the proof of delivery. Anybody in the same boat?

Come on folks. There are some real smart people on this forum. Some of them know more about immigration than the blood-sucking law firms that I have dealt with in the past.
If anyone can shed any light on this, it will be appreciated.
Good new for you is that it is posible at least manually but I am not sure about automatic. I am some what similar situation but my new I140 is not from same company. I am not able to find that I need to work with company whose I140 is approved for 6 months before using my EAD.
I called uscis today and agent(even second level) didnt tell me about what I140 linked to my pending 485.

The reason USCIS does fingerprinting every 12 or 15 months is because they collect it on paper and keep it on paper.
Finger prints that are on paper and not in computer tend to get deteriorated after a certain time because paper is not 100 stable and reliable medium to store fingerprints.
I asked this question to a USCIS officer at a symposium and he said that he understands that it sounds ridiculous but if every place had computerized fingerprint collection and storage facility, they would stop asking for fingerprints every 12 to 15 months.
I dont know how much of this is accurate, coz I am really not an expert on paper and ink and fingerprinting technologies. But it seems that in future, this "Expiring fingerprints" will stop once they are more computerized.

Not sure what is means though. The "explanation" has been there for quite a long time... at least not just started this month. How does this actually explain the "retrogression"? :confused:

Let him not return original I-797.
It will be required sometimes during H1B stamping. US consulate during query time they might ask for all the previous original I-797's.
In the year 2006, when I was travelling by road from CANADA to USA(DETRIOT PORT OF ENTRY) after visa stamping. Immigration officials requested for all my(including dependents) I-797 originals. Glad I was carrying all of my originals.
They insisted me to show just the originals.
You don't know when they will be required. Why the heck WIPRO wants it back when they will have their own + attorney I-797 orginals.
It seems like your friend's exit from WIPRO was not mutually agreed and they are trying to pull his leg.
Tell your friend to ignore their emails, phone calls, letters.

everybody seems to get AP pretty quickly, I got the EAD in last october pretty quickly at that time. What might have gone wrong I am wondering since Jul 25th I am just wating ,there was a daily LUD change on it till july30 after that nothing .. even thing like AP we have to dream now
