As always, I am so confused whether to go for Canadian Immigration or not guys!!!! There are only 2 questions, Weather and Medical, other than that Canada is on par if not better than US in my view. I am here in US for 10 years now, as you can imagine my Green process is pending for a long time too, so to let it all go, its really hard. With my luck, the day I immigrate to Canada, the priority date might become current who knows......Any advice on pros and cons....

Answer: A change of status is easy enough to file. The issue you will run into is whether anybody other than your current employer will hire you back with just 1 year left on your H1-B.
2) This is definitely the best option. I hope my employer lets me take a 2 year leave of absence. I've heard of people taking a year but 2 years might be a challenge.

Yes BugsBunny, I did had a question regarding The employer-employee relationship during my interview . I do report to my Supervisor regularly, infact we do have a regular updates on my as well as his side. The Consulate officer did ask me that.

Can you please tell me how you can work on OPT when your H1B has been approved? If you were in the US when you applied for H1b, you should have gotten a Change of Status (COS) when your H1b was approved. This means that your OPT is no longer valid. Am I missing something here?

DOS may release a revised July VB to show some 'priority dates' or may opt to release the visas in August VB. Whatever they choose to do will be atleast something good of some of us but not for everybody.
If, they release some visas in August, what will be the fate of applications already in their mail room.... This would lead to more confusion.. Also accepting only the application already in the mail room, sets stage for anotherlaw suit, for folks who had not applied due to the confusion DOS created.... but with much earlier PD. So this is kinda tricky... They have to come with some sort of solution such that they don't penalise folks waiting for longer time...

Could these be issues with two systems? Knowing USCIS that will not come as a surprise. I got an update on the USCIS website stating that the post office returned some I-485 correspondence they sent to me. I found out through my attorney that this message was in error. They have not changed this message for years now.
Look at the glass as half full - you are already current - it could be that the system has not updated your I-485 information while the CPO message is accurate.:)
Yes I am hoping so. but untill i dont know if 485 approved or not i cant plan ahead. i have an urgent travel on october 8th. this uscis mess has delayed me to go to local infopass office to get I-551 stamp. this is height of stupidity. I have valid AP also but they say dont use it if 485 approved.

I am an H1B and have 4 dependants as H4s. My Labor Certif was submitted as EB3 on 08/06/07 is "In Process" .... I still don't know how far or close I am from the GC. I will like to participate and understand better this process.

Hi Folks,
I had applied for AOS,EAD and AP for me and my wife on July 2nd.
I got my EAD, Finger Printing Notification, but my wife's application got returned on Aug 30th. I called USCIS after 3 months to find out status on her case and they said it was returned on Aug 30th which we haven't received so far. The reason for rejection was incorrect or missing check.
So, can please any one tell me if i can re-apply her case even though i did not get her application back?
Any information on this will be greatly appreciated.

You will have H1B from company A until they cancel it.
Will company A come to know about the H1-B transfer application?
Will USCIS contact company A and verify what i have complained about?
No they cannot ..USCIS never request from previous employer directly.If you complain, USCIS will audit the company A and they will not reveal personal inforamtion of your unless you authorize them to do so..
