My wife is a CA with about 5 years indian (internal audit) experience?
We have recently filed her EAD.
My question is can she take up a job first and then study/pass CPA exams or pass CPA exams and then search for Job?

I don't agree with Batch processing unless we see NO approvals from NSC. But there are couple of approvals. Why did they get approved?
Those might be as per the processing of last week of July. Also all the cases approved have PD before 04/2004.

the instructions to apply for advance parole asks for "a copy of any document issues by USCIS showing present status in the US"
since I am no longer on H-1B (I left my sponsoring employer last year) and I have been working with a different employer on EAD, what document should I send to show my present status?? by the way, I have a pending I-485

I currently have a 485 pending under EB3. Company filed another PERM under EB2 which has now been approved and I now would like to port over to EB2 category. What is the process of doing that?
1. Do I just file another I-140 and 485 (PD is current) concurrently or is there a way to simply convert my EB3 to EB2 in order to take advantage of current PD?
2. Can 2 separate AOS be filed under 2 different category?
Your help will be very much appreciated.

I did some analysis for EB2 and EB3 India using as well as IV data. It provides a rough estimate of the approved and pending 485 applicants for India.
Reading through the excel sheets, you can easily understand what approach I have used to come up with these numbers. Of course, I have made a lots of assumptions and the analysis may not be correct. I did it anyway :) .

The following questions are not related to Immigration process. However, they are very much related to each one of us.
All of us have paid a percentage of our salaries towards US Social Security. Having been worked for say about 5 years in USA and one wanted to go back to his/her home country (say India). What would happen to so far paid Social Security amount.
I have worked in India (paid Provident Fund) and Singapore (No Provident Fund /Social Security unless resident is a �Permanent Resident� or Citizen) and USA (All most all residents have to pay Social Security).
In Singapore, if a person who is a �Permanent Resident� and paying CPF (Common Provident Fund) would eligible to take his/her CPF back after surrendering the �Permanent Resident� Card/Status.
In USA, I knew, we are eligible to receive Social Security after attaining a minimum of 40 points and one must be above 65 years. No matter, which part of the world we live, we are eligible to receive our amount provided if the Social Security is not bankrupted.
I heard that few other countries (in Europe) would transfer such Provident Fund/ Social Security amount to the respective individual home Provident Fund/ Social Security account, when the individual is returning for good. How true is this statement?
Is there such process exist in USA too? If not exist what should be done to initiate such process (transferring Social Security amount to the individual home Provident Fund/ Social Security account), when the individual is returning to home country for good.

What you are saying below appears to be the best way to handle this. I wonder, however, that what happens if the AOS is denied based on new EB2 category. Does the AOS based on EB3 still continue?
To my knowledge, you can have only 1 I-485 Application with USCIS.
My Lawyer did the following steps in my Case.
1. Apply I-140 in EB2 Category and requesting to port the PD from EB3 (attached the previously approved I-140) and a cover-letter to port the PD.
2. Once the EB2 I-140 is approved, then he requested USCIS to use the approved EB2 I-140 (already PD is ported) for adjusting the pending I-485 application.
I also confirmed with USCIS field office the newly approved I-140 is attached to pending I-485 application for me and my wife.
Hope this helps in your Case.

I am in the DC Metro area and I had a surprise visit from an USCIS officer(Contractor) and he asked
my title,
annual salary,
how long I have been with my employer,
Did I have to pay or reimburse H1B filing fees,
my education and
my employer's address(I was at a Client Site).
He also so said this was a random check and there was nothing worng with my H1-B application or petition status ( My petition for renewal was approved in August'09). I am not sure why they are doing the check so late.
Hope this helps folks to be prepared just in case they have surprise guest at your work place.
