So without the old application, can i not refile?
Unless you receive the rejected application, you will not be able to re-file. The original returned application will have a case number on it and that is what essentially matters. If you can show that it was NOT your fault the case was rejected, the case can be accepted.
I have one friend whose application was rejected for "missing fee" which was not true. His attorney sent the SAME application (stamped by uscis) with cover letter and a new check and last Thursday he received a receipt. The interesting part is that his new receipt shows the same case number as it was initially rejected and the online status still shows, "case rejected." I guess, it will take a while before the online status changes to "pending." And yes, his attorney told him he skipped the mail room.

Did anyone notice that NSC is processing I140 with a receipt date of Jan.1, 2006? Wasn't that used to be Sept. 2006? This is just getting better and better... I140 retrogression! :mad:

If you send your 485 receipt copy and Marriage Certificate you should be fine. Since she was applied as your dependant, you have to submit your 485 as well and marriage certificate to prove your relationship.

just an FYI, I had an infopass after shifting to new employer...They will not ask any question s related to AC-21, job change...they dont have time/patience...they will only answer what you ask or less...:-)

If your I-140 is approved then you can transfer your H1 to another employer with the copy of I-140. You should get 3 years extension with new employer. But make sure when you file transfer at that point the I-140 is not revoked by your employer since H1 extension is soley based on I-140. Alternatively if your LC was filed 365 days before your end of 6th year, then you should be able to get one year extension with your new employer.

If they accept as per WSJ article "some early apps from July". This is totally unacceptable and cruel to all those who followed the rules and statement of USCIS.

I think IEEE and SIA are speaking our langauge after a long time , and what I am dumbfound about is that how come Programmers guild can count only 1500 people as its members get front page coverage in BusinessWeek and we Immigration voice who are 30,000 strong not respond to their baseless allegations . I would recommend we supporting IEEE and SIA by calling senators and faxing them and sending our own support letter like Programmers Guild is doing and writing to the reporter in the article.

Kerala Mela - On Saturday, October 28 Maryland Soccerplex. There are 10,000 people attending this huge event. But when you come, ask nanny question and disappear...did you ever thought about people who spent lots of time, money and energy to fix the whole issue. Are they only going to get the GC...or anything special for their effort and sacrifice.?

I know that with EAD I can Join back . But some people are saying that ac21 will be revolked after bill passes. Is it true? Then I will stuck with that old employer.
I am just interested in Extension and not in GC/EAD.As I am planning to go back to my home country.
Any thoughts guys?

All most all lawmakers understand this, they also understand that sending us back home will not help another American get a job, most likely result in leaving ten other jobs with us.
We can explain our situation and how CIR can help to get us out of this mess. I don't think we need an FAQ for this, most of these people are very friendly and are willing to listen.

I advice you all to walk in to ASC locations.
I went to one ASC location as walk in. They asked me to go District office where I already tried with an Infopass appointment.
Then I tried at another ASC office, and pleaded them saying my dates are current, take my FP, then I can get my GC. That officer is nice, he took our FP and they were cleared and sent to USCIS yesterday.
I will say, try in at least 2 ASCs at least twice at each ASC. Infopass is waste.
I went in the morning around 8.30 and there were only 4 people for FP and that officer took our FP after 40 min phone / PC communication.
Good luck to all.

PD, ND, RD - None of these matter at all. You will ultimately have to go through whatever is in your destiny. The July Fiasco is ample evidence of that. Because of this fiasco people who filed in 2006 may get their GCs before people in 2001, so no date matters in the end.

I had more than 5 years to experience from the previous company which the current company used as a basis for EB2 and it was successful. There was no problem with my EB2 PERM.
Congratulations! My lawyer recommended against switching to EB2 even though I am in a managerial position and have ample work experience due to the poor economy. He cited that there were many unemployed and it would be difficult to convince through PERM that no qualified candidates were available. Is that what you did or did you obtain your masters?
