I feel the same way. I know that they have no reason to let me go after I gave my 2 weeks notice. The new employer is not a competitor and not even in the same industry, so no conflict of interest there.

Try to see if you can find a labor relations attorney in your area. Or goto DOL website and see if you can find DOL attorney... to help you out. It is a good thing that you are taking stand.

just got axed, 2nd time in 12 months, LOL...
really want to take a couple months off, just rest, relax and think about what to do with my life.
PD is at least one year away. but in 2007 fiasco, there were people in my situation but with PD just a couple days earlier got GC. US immigration system really has no certainty at all.
My question is how likely i could get RFE'd for employment in the next 3 months? if get RFE, any tactics to stall?

I think my old employer will keep the word of filing the 485.
And yes new company may take me back or may not.(Nobody will promise that to you in IT atleast)
I know that with EAD I can Join back . But some people are saying that ac21 will be revolked after bill passes. Is it true? Then I will stuck with that old employer.
I am just interested in Extension and not in GC/EAD.As I am planning to go back to my home country.
Any thoughts guys?

I don't think you can have the best of both the worlds. You have to compromise somewhere. I myself left too many lucrative offers to stick with desi company (the big one not small consulting) where I work 10-12 hrs, report to some stupid people, my client loves but cant hire me and at the end of the year do not get any raise even graded as an A+ employee. So you know what i'm talking about.
One more thing...I left top big 4 consulting company to join this desi company only because I knew only they can do my GC. Big non-desi companies have just too many process before you can even file GC.
Rest is your decision.

but won't the unused EB1 numbers roll into EB2 ? remember, each of EB1, EB2 and EB3 are at 28.6% of country quota (7.1% each for EB4 and EB5). there are never enough guys to fill EB1, so EB2 benefits from it.

In fact there are more than 'enough' guys in EB1. EB1 remains current just because there are not enough guys in EB4 & EB5. If you look at numbers, EB1 numbers are not rolling in EB2

My gut instincts tells me that dates will magically move fast once the fee increases are in place.
Without immigration reform..priority dates would not move...There is absoltely no possiblilty that the date would move....

Based on my own (horrible) experience with AC21, I would advise you stay where you are. Keep your case clean with respect to I-140. Take GC and then plan your life from there. Anyway you are just a few months away from GC. Why invite trouble? 15% rise or some improvement in overall benefit is not a good offset for the risk that you are taking.

Since H1 is already expired and working on EAD, if new employer files for H1, i heard that the applicant will have to go out of the country for visa stamping.
The new H1 approval will not have I-94 :(

I think this is correct. New H1 is considered as "new h1" :) and has to go through exact same formalities like filing H1 for first time.

I strongly support IV sending a similar letter.
We should wirte names of IV members, their location and/or employer, and a comment or two. This should be delivered to congressional leaders asap!!!
When we show 10,000 faces on the letter, it will be a powerful force.
Cannot agree more . if it is numbers they want , it is numbers they will get . Numbers so overwhelming that it will run ProgrammersGuild down .

No clue sweet jungle, I understand you are talking from the perspective that ideally you need to work for atleast 6 months post GC for your filling company. I guess he will know when he applies. From my personal opinion, i think he would be fine. Since he did not violate any rules here. By the time it comes to citizenship. Assuming he and his wife are making good money and have all the relevant tax records for the past 5 years, I dont see why any sensible person would give them trouble.

I'm not a good enough artist to be able to make many drawing changes. While I've drawn most of this, it took me a long time. So I can fine tune the drawing a little. Mostly looking for a selection of witty words.
If Suren has time to make drawing improvements that's another matter, he's a much better artist than I (he did the plumber and gauges).

So China's 1.3 billion gets a under 10'000 available GC's, the same as the UK's 60 million?
And then those figures get chopped up again into the different EB priority categories, right?
So someone, say, applying for an EB3 has to fight for one of .28 x 9'800 = 2'744 availabe GC's?
If this is right, then I am hardly surprised that people are looking at 12 years plus. Id imagine the number of people from countries like India and China trying to apply for EB2 and 3 must be huge. WAY greater than these figures could cater for.
Then again, I am purely speculating here.

We filed for My Son's EAD on 17th september to Texas SVC Center and today we received Physical card at home. This is a surprising experience.
The same kind of experience for AP. Today our APs got approved though original papers have not been received yet.
Is this normal work out time for EAD and APs for the USCIS or I just got lucky?
