I am planning to send I-140 copy + My i-485 Receipt copy + Cover letter explaining scenario + All supporting docs for my daughter.
Any thing else should I send with it.
I don�t understand one thing. Her AP receipt number status is "received and pending" and also USCIS has cashed money for her I-485 , so how come they reject it.

Insurance agencies are going to crumble given the new laws, talk abt covering visitors with pre existing conditions
In that case all visitors will get cheaper medical treatment just visiting America.
Govt is not the answer to all probs, although its the only in terms of GC though.

You can call UPS and give them the address and they will let you know whether it's deliverable or not..
You are correct, i just called UPS and they said they WILL NOT deliver to P.O Box addresses. They need to have street address. Does USCIS provide other address where these UPS/FedEx/DHL can deliver?

DOS may release a revised July VB to show some 'priority dates' or may opt to release the visas in August VB. Whatever they choose to do will be atleast something good of some of us but not for everybody.
If, they release some visas in August, what will be the fate of applications already in their mail room.... This would lead to more confusion.. Also accepting only the application already in the mail room, sets stage for anotherlaw suit, for folks who had not applied due to the confusion DOS created.... but with much earlier PD. So this is kinda tricky... They have to come with some sort of solution such that they don't penalise folks waiting for longer time...

If I have an expired H1 visa in my passport but I have a valid H1 extension I797 with a valid I-94, I can re-enter US withing 30 days after leaving US to canada? Is that true based on visa revalidation eventhough I don't have any valid stamped visa in my passport
I am from India. Ppl from Iran, syria, etc (7 countries) do not have this privilage.
You must not apply for stamping in US consulate.
You must not travel to another country from Canada
You should be back within 30 days
The Expired Visa on your passport must match the current I797/I94

I think if you switch from H1 to an F1 and then want to get back to an H1, you will be counted towards the 65K cap.
It will be a brand new H1 application, so it has to be under the cap. So think twice about switching to F1, it's not easy to just switch back and forth.
Make sure you get confirmation from an attorney though, don't assume everything on a forum as perfect legal advice.

She cannot use the AP now even if it is approved as she left to India before you receive it. The AP approval has the date on when it is approved so even if you mail to her, she might have issues at the POE if she tries to use it. I would rather have her come on the H4 visa if she has a valid visa.

As mentioned, we both don't have VISA stamped in our passport. Do you foresee a problem if we both apply for VISA appointment at the Mumbai Consulate to get H1/H4 visa stamping. I am not sure what else can be done.

Easiest way to handle this is to file the tax with H&R Block.
Just approach them with last pay check from your employer (which can indicate approximate total annual income) and explain them about your efforts to get the W2.
They can prepare the SUBSTITUTE W2 for you and IRS will then screw your employer for not providing the W2.
In my case, my previous employer failed to give W2 until March 31 (I called him 20 times and each time I was told that concerned person was not at the office).
So I approached H&R and prepared substitute. But when I was about to file the returns based on it, I called my previous employer and told him
"If you are not providing W2, not me but you and your company will be in trouble, because IRS will ask you the reason."
I received W2 through fax in next hour!!.
So keep trying and then approach H&R

Your new passport will start immediately, as they have to cancel your old passport. And the validity will be 10 years from the date of issue of your new passport.
If your passport expires in less than 6 months, I believe you will not be issued new VISA. However, if your passport has more than 6 months of validity at the time of applying for the passport, it will not be a problem.
Is it better to get new or old passport: Well, I believe you will end up carrying both passports for a while -- you will have to keep the old passport for various official purposes, except for travel -- so if you travel a lot, a new passport will be better, if not, go for the visa on an older passport, and remember to carry both when you are traveling.
