I have heard this POJ method to call USCIS. Can someone explain what is this method and how to use it. Also, can we summarize a list of questions, one should ask an Immigration Officer while on the phone.

The OP has not filed for I-485 yet, so what is the grounds for approving a new 3 year H-1B petition with a different employer?
Question for those who got an extension approved based on the approved I-140
- Did you have a I-485 pending at the time of filing for a new H-1B?
- If not, then what did you write in the cover letter ;) ?
Is AC21 applicable here when no I-485 is filed?

Infact I saw in their website if we send the application by mail we will get it by mail otherwise we should pickup. You should go to their website and read carefully

Hello all,
After working for 2 big companies for about 8 years, I am considering joining a startup.
Am currently in the 7th year of H1B, but have another 3 year extension (based on i140 approval - PD 12/05 ) stamped in my passport.
Am trying to understand any risks involved in joining a startup from a immigration status point of view.
I think my H1 can be transferred.
I have a copy of my I140 approval so am hoping I will be able to port my PD.
But in general, what are the ther issues/risks/concerns I should be aware of?

Hello,
Can someone help me with this question?
My wife has worked in the USA on L1 & H1 for 3 years. She then took a 3 year break due to the kids and is planning to go to work coming september or october. I don't have a green card yet so she has to get a H1 to work. We'll be applying for change of status from H4 to H1 but i wanted to know if her H1 counts in the H1-B 65K cap.

No..I dont think so she will be subjected to the cap as I know my friend who was on H1 for 3yrs..went back to H4...but totally the H status was less than 6 yrs, so she dint have to wait for the quota, she got her H1 on the 5th yr of H4..that is in Dec 06..

thanks copsmart! So you are saying that currently my wife is on h-1b status even though she did not actually worked for that company yet. I wish they considered her as being on h-4 status. Btw, while applying for ead, what should i put in for question 15 (current immigration status) on form i-765? In her initial ead that got approved in october'08, she had this answered as h4 - dependent. do i have to put in h-1 there or can i put in h-4 or aos instead? thank you!

I need this urgent help. I was on H4, got my H1B this year through a consulting company. My EAD got approved meanwhile in this july flyer and got my card as well. My H1b sponsor Company knows that i got my EAD and they are showing least interest in searching for a job for me and neither they are responding back to my emails. I have my EAD.
Is is advisable to use my EAD to get a job?
Can i get my ssn using my EAD? If i do that, do i lose my H4 and H1B?
Do you advise me to change the H1b to H4 again?
Can i technically retain my H4 and use EAD?
My hubby is on H1B and has an approved EAD but is not planning to use it as he is happy with his present employer, so he would be on H1B.

When they start processing the 485 AOS,they allot visa number.
If it retrogressed but visa number had alreday been alotted to her case,approval is possible,otherwise June 2005 approval is not possible.
If it happened,it means august bulletin might have June 2005 as cutoff date(they secretly changed the July VB and changed it back to "U" from "C"

Once you get your duplicate passport, just visit local USCIS office with an appointment. You will get a duplicate I-94 card. At least two of my friends did the same thing. It is not a big deal.
Or meet an attorney, pay 200 USD and get the same advice.
(I am not sure if you need to report lost passport to your local police. If it is not misplaced and lost in luggage etc, I would give a complaint)

I am planningt to apply a visa for my monther (widow), she appeared once in Chennai and they asked more evidence on ties in India but we did not respond to that as she was not interested in that - this was two years back . Now I am planning to re apply her visa, she lives in Hyderabad and now we got US consulate in Hyderabad (India).
Can you please help me gather all documents I need to send and also what all documents I need to submit from India on behalf of her. I really appreciate and thank you in advance for your help.

Dont go for consultants. They explain different stories to your parents and your conditions and circumstances are different. We did the whole paper work ourselves. If you want any more information please do not hesitate to ask I will be more than happy to help.
Mainly I focussed on these things for my parents after 2 rejections
1) Why they want to come to USA
2) What are their ties to India
3) Who will sponsor their trip
4) How long they will come
I did prepare a cover letter addressed by my father laying down very clearly what is the purpose of their trip, Social Ties and responsibilities in India, reason for coming back, Financial support for the trip. and also focussing on family in India. Although the visa officer never looked at any of the docs.

Hi,
My H1B visa application at Chennai Consulate ran into additional administrative processing requirements. I was given a pink slip stating that the visa cannot be issued until then under Section 221(g). My I-485 application has been pending since Aug 2007 and this is a regular H1B extension petition. ( In hindsight I wonder if I should not have applied for a visa at all and used my Advanced Parole to return-- only the lawyer was recommending to maintain a valid H1B if possible without much difficulty).
I have gotten the H1B stamping at Chennai Consulate for the same employer few years back. Not sure why they would require more processing now. I gave all the information requested by the interviewing visa officer and I had almost all documents in hand starting from I20, tax returns for the past 10 years, bank statements, experience letters etc etc. But were not asked for.
Does anybody know of any way of speeding up this additional administrative processing?
Can anything be done other than waiting for the passport in the mail?

I am in similar situation. Our 485 were denied by stating PD was not current when it was filed. But we filed during July fiasco.
Now it is almost 5 months and no update on our MTR :(
Lawyer said they filed MTR also went through AILA but no help.
What to do now? Should go for Infopass/Congressional inquiry?

This is so great. And unfortunately so true. We are ready to fall in a black whole at any time. But remember that Mr;) . Frodo destroyed the ring and got back in the sunny meadows. The Green Card is waiting at the end of the tunnel. Hope we'll live to see it.
