decide on a date.
all the pepole who are waiting for their gc skip their work on that the day.stop all activities on that day (shopping..... etc)
and let the people know how difficult it would be to live without you.....

I am reposting from 'a day-off' proposal discussed few months back. Please, be aware in this country NO BODY has heard of/appreciates strikes, dharnas/hartals or even black badges. These things backfire. Protests in civilised ways are welcome.

I invoked AC21 and changed employer in November.
I received an RFE today when my PD is nowhere close to what USCIS is processing. I was wondering if anyone else had any updates on their cases with priority date close to mine.

One more thing is I got finger printing notice in Aug 30th with FP scheduled for Sep 23rd. And I got the CRIS email and status updated on Sep 15th. If the status update corresponds to FP, USCIS server is 15 days slow in generating this email. If it is a private business ... USCIS would be bankrupt long ago...

Yes I agree with you, that's an option I have, I want to see if there are other options that will allow me to continue on current FT and still have my previous employer (consulting company) do the EB2 I140 to get my GC. How about a part time job with my consulting company while I'm still working on FT with my current company.
Any other options?

we are talking directly to the admin on this, recent USCIS
statements show that significant progress has been made towards
the idea of a 3 year EAD/AP. another important change we are
pushing for is a change in EAD work description to allow for
"similar" and "related" occupations, not in the precise occupational
code. also recapture remains on the table, hard as things are.

On some of the above threads, It is being told that If you and family have pending I-485s and
"If your spouse need to apply or work on EAD than YOU WILL HAVE TO APPLY FOR EAD, IF you dont apply for EAD and continue working on H-1B YOUR SPOUSE CAN NOT APPLY AND WORK ON EAD"
As I understand this is probably wrong, for spouse to apply and work on EAD, PRINCIPLE APPLICANT NEED NOT HAVE TO APPLY FOR EAD AND WORK ON EAD. As per my Knowledge principle can continue working on H-1B even if spouse start working on EAD. Even my attorney, through him I applied for My spouse's EAD, Advised me to Continue on H-1, so that something negative happen on Our I-485's she can come back to H-4.
(I am still in first yr of H-1 B and my I-140 is already approved and I-485 pending for almost 4 months)
CAN EXPERIENCED MEMBERS CLARIFY ABOVE ISSUE, as some of the replies on above thread are confusing in regards to Spouse and principles EAD and H-1b status.

We recd the EAD cards in mail, but haven't got the FP notice. The EAD Card says no finger print available
Is that a problem and how to find out if the FP notice has been mailed or not. Does is come in the online case status of I485?

I think , I don't agree with camarasa.
First , u can file I-140 earlier or concurrently with I-485.
Secondly, EB2 or EB3 is important only for determining if you PD is current or not.
Third : You did not commit any fraud from ur side. (Albeit Do preserve response to the RFE)
Fourth: What the worst will happen? If say EB-2 is current and you file but it gets rejected because PD was not current, SO WHAT? File it latter, it is not going to play against you. Most likely rejection will not happen as USCIS system will also show EB-2.
One suggestion though: Call on USCIS to confirm that the approval is indeed for EB-2

What if they start processing your I-485 and because of the backlog (which could be around 2-3 years maybe more because of the July 2nd fiasco) they only start wrapping up your approval 3 years later, at which point they spot the problem and tell you to refile your I-140 and I-485 again under EB3. Would you think it was worth it then?

One of the training institutes, want to hire me for teaching some IT classes.

December VB is an eye opener. Doesn't matter EB3 or EB2, unless WE get together to work for change, it will be a very long wait to complete the GC process for many of us.

It states that if you have filed just the 485 for the first time using the new fees and then plan to file 765 and 131 you don't have to send the fees again. But its not true with the renewals, i think so, may be worng.

as per my lawyer....anytime before the application gets adjudicated.
Please check with lawyer again. I-485 can be filed for dependent upto 180 days after I-485 approval for the primary beneficiary.
The dependent must be related to the primary applicant BEFORE I-485 approval.
