    I had a Infopass apt this morning and the IO told me that my name check was cleared. My PD is Jul 2005 (EB2 India). 140 approved 18 months ago. anyidea I get approved in August?
    Did u ask that to the IO during infopass. If he could not give u guarantee how can someone on IV..

    agree with krishmunn and gc2.

    An amicable solution is the best. DBA jobs (corp-to-corp) is aplenty, especially if you are willing to move. Not sure why he is eager to drop the 140 and send you out.

    I also asked you about the time you traveled outside. that will be helpful for recapture, just in case you need to start all over again.

    my hr is saying that extension is possible only 6months before actual expiration date. will the h1 transfer need to be in the 6 month window also?

    Transfer does not have to be in the 6 month window. Transfer can happen anytime. You can get upto 3 years based on approved 140. So go ahead and do it ASAP. Don't wait to get layed off. Keep all documents, copies, paystubs, w2s everything ready.

    When I filed my AP on line ( e filing) I got it in 7 days , because my expected travel date was within 15 days of my application.

    If your travel date as mentioned is very nearer , then they process fast, whether it is paper application or e filing.

    How about changing jobs after recieving GC? Can we switch to the job we like with out any regards to changes in job duties? how about taking a break?

    As mentioned in my previous post, one should at least stay with their employer, at the time of GC approval, for around 6 months to a year .

    Then again, nothing about the time line is case in stone (that is nothing is said in the law books). However the shorter the duration, the more the burden on you to prove that you did not get your GC with no intention of working for the employer.

    As someone else mentioned AC21 invalidates the requirement that you need to work for the same employer. That is a gray zone. Based on my understanding:

    1) When applying for any stage of the processing, you need to have intent to work for the employer (otherwise, legally you have committed fraud).

    2) Even with AC21, I believe you need to stay with your then current employer for some period of time after getting GC.

    I know people who have left their jobs within a month of two of their GC and have had no problems even with their citizenship. So it is up to you to maintain your own good sense of security on how long you want to stay with a company after GC. Most lawyers' opinion is to stay for at least a year - provided (their boiler plate advice) that you dont have premeditated intention to leave.


    Once you are happy and secure with the "cooling off" period after GC, you can work in any field (not meant to deride, but you could also work as a hamburger flipper if you so choose), or take a break.

    Dumb question.
    considering that she will get her h1 in April(premium processing)
    Valid only from say Oct 2007.
    Her current h4 xpires may 2007 .. and my company will extend it.
    If she leaves country say in June .. and come back July .. she will need to get her visa stamped.
    So:
    Can she get both her h4 extension and h1 stamped on passport?
    Or only one .. if yes which one ?

    Also when is the earliest she can get her new h1 stamped on her passport if need be? (it gets approved in April 2007 .. so between April and Oct .. when's the earliest she can get it stamped.)

    Sorry for so many questions.

    This is a difficult one. You will need to talk to the consulate to confirm. I know that she can not have and consulate will not issue 2 visas (H1 and H4) stamped on her passport both of which are valid at the same time. So if she applies for H1b stamping then she can not return back no earlier than 2 weeks prior to the start of her H1. So if she wants to return early, she probably has to get a H4 stamped and then on October 1st her status will change to H1, which means next time she travels, she will have to apply for h1B stamping.

    actually its not that simple. I have been on and off tracking EB immigration for almost 8 years now, and in every timeperiod there have been bottlenecks. The bottlenecks have moved around, but the process overall has remained screwed up.

    LC used to take many many years, then PERM was brought in to speed things up. PERM was very fast in 2005/2006, not its all bogged down in audits again. I-140 approval used to take 18 months, then premium processing came, and now again thats gone, and we are back to 12-18 months. Pre-retrogression people would get stuck in namecheck, now that the name-check requirement has gone, dates (esp EB3-India) are not moving fast. And even if they do (EB2-india Aug/Sept) approvals are not flowing in fast enough (NSC especially)

    I agree with you for the most part. At this point, as you said in your post, most other issues are towards improvements, retrogression still sucks!:eek:

    If one has an Approved Multiple Entry Advance Parole until Nov 2008, is it safe to stay out of the country from Jan2008 till June 2008. This is for the dependent spouse NOT the original beneficiary. I am concerned becuase of the unusual length of stay outside the US. Can someone please respond.

    How much time does it take to get the approved AP, if the application is received this 29th. I have already sent the application and is expected to reach by Monday or Tuesday. I have plans to go to India in the the third week of January.


    How to apply for AP online? I already have EAD extended for 2 years.

    1. How does the EB3 process get affected if the EB2 140 is denied? In other words, are they independent of each other?
    Usually, unless eb2 I-140 is denied due to fraud, it does not affect eb3 I-140.

    2. It appears that you got both the applications from the same company. Mind telling me what the titles of your EB3 and EB2 positions were? Do they have to be completely different?
    These two are different job positions and can have different job title, duties, and/or job descriptions.

    Interesting topic. 2 questions

    1. I-824 takes long time. Is it ok to leave country immediately after filing I-824 or do we need to wait for approval

    2. Based on what you said w.r.t AC-21, the job offer at the time of CP interview need to not from originally sponsoring employer, but ANY employer conforming to same/similar job. Is that right?

    As an example, I already invoked AC-21, joined new employer and using EAD. If I were to go back to India and opt for CP, is it sufficient if I have offer from ANY employer?

    Your wife can talk to the employer and ask for refund saying that you have receipts (if they dont respond tell that u'll report it to labor dept., and will proceed legally). After one year he cannot threaten your wife for joining the client, he'll definitely loose the case. Since employer has right for labor substitution he can do it, but you can get ur money back saying you can prove that they are at fault.
